1. Introduction

These Terms of Service ("Terms") cover your use of Garden Canvas ("the Service"), provided by Iterate OÜ ("we", "us"), located in Estonia. By using our Service, you agree to these Terms.

2. Subscriptions & Payments

  • Billing: You agree to pay the fees for the plan you select. Payments are processed by our third-party provider, Stripe. We do not store your full card details.
  • Renewal: Subscriptions automatically renew at the end of each billing cycle unless canceled.
  • Refunds: All payments are non-refundable.
  • Price Changes: We may change our pricing. We will notify you 30 days in advance of any price increase.

3. Acceptable Use (The "Don't Be Evil" Clause)

You agree NOT to use the Service to:

  • Host or transmit illegal, harmful, or fraudulent content.
  • Send unsolicited emails (SPAM).
  • Reverse engineer or attempt to hack our Service.
  • Resell the Service without our permission.

Violation of these rules will result in immediate account termination without refund.

4. Your Data & Content

  • Ownership: You own the data you upload to the Service. You grant us a limited license to host and process this data solely to provide the Service to you.
  • Hosting Location: You acknowledge that your data is hosted on servers in the United States (Google Cloud Platform).
  • Backups: While we perform regular backups, you are responsible for keeping your own copies of your data. We are not liable for data loss.

5. Termination

  • By You: You may cancel your subscription at any time via your account settings. Access will continue until the end of the current billing period.
  • By Us: We may suspend or terminate your account if you violate these Terms or if legally required.

6. Disclaimer of Warranties ("AS IS")

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.

7. Limitation of Liability (Critical)

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Iterate OÜ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (INCLUDING LOST PROFITS OR DATA). OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE LAST 12 MONTHS.

8. Governing Law

These Terms are governed by the laws of Estonia (or your country of registration). Any disputes shall be resolved in the courts of Tartu.
